The New Patriotic Party (NPP) parliamentary candidate for Ablekuma North, Nana Akua Owusu Afriyie, has filed an application at the High Court seeking to stop the Electoral Commission (EC) from conducting a rerun of elections in 19 polling stations scheduled for Friday, July 11, 2025.
Her legal team, led by Gary Nimako Marfo, is challenging the EC’s directive, describing it as unlawful and a breach of a previous court ruling.
In the certiorari application, Mr. Nimako urged the court to quash the EC’s July 1 and 2 communications announcing the rerun and to prohibit the Commission from going ahead with it.
According to the application, the EC committed a serious administrative error by ignoring a High Court judgment delivered on January 4, 2025. That ruling, the lawyers argue, directed the EC to collate and declare results from the original election without mandating a rerun.
“The EC acted beyond its jurisdiction. There is no new court order overturning the January 4 decision to justify a rerun,” the application stated.
Mr. Nimako also described the EC’s actions as “arbitrary, capricious, unreasonable, and a wrongful exercise of discretionary power.”
The EC had earlier announced its decision to conduct a rerun in 19 out of 37 contested polling stations following discussions with political stakeholders.
“After extensive deliberations, the Commission informed the political parties that it would proceed to rerun the election in 19 polling stations,” Deputy EC Chair in charge of Operations, Samuel Tettey, said in a statement on July 2.
However, the NPP swiftly opposed the move. At a press conference, NPP General Secretary Justin Kodua Frimpong said the party “completely rejects” the EC’s decision and will challenge it in court.
“We’ve given firm instructions to our lawyers to proceed to court to challenge this unlawful, whimsical, and self-serving directive,” he stated.
Nana Akua Owusu Afriyie’s main rival in the parliamentary race is Ewurabena Aubynn of the National Democratic Congress (NDC).
