Judicial Service letter strange and ridiculously unreasonable – Law lecturer

A legal luminary Dr. Rainer Akumperigya, a barrister and a lecturer at GIMPA, passing preliminary comments on his Facebook wall on the Judicial Service letter stated that the letter was strange and ridiculously unreasonable.

He explained that “the constitution itself is a property of the PEOPLE. Every power, authority, or institution that emanate from the constitution belongs to the PEOPLE.!!! The Constitution cannot threaten the Constitution same way the PEOPLE cannot threaten the PEOPLE”. The reason he describes the letter as strange and ridiculously unreasonable.

He subsequently maintained, anyone who has had anything to do with the law, purports to act in the interest of the law, is an officer of the law, or remotely close to the law must be familiar with the terms of the Preamble of our Constitution and not act contrary to it, he said.

“This preamble should be posted on the walls of every public office including the Judicial council. It should replace the picture of the President in every office of our Republic, henceforth”, he concluded.

What a strange and absurd letter from the Judicial Council. The constitution itself is a property of the PEOPLE. Every power, authority, or institution that emanate from the constitution belongs to the PEOPLE.!!! The Constitution cannot threaten the Constitution the same way the PEOPLE cannot threaten the PEOPLE.
Anyone who has had anything to do with the law purports to act in the interest of the law, is an officer of the law or remotely close to the law must be familiar with the terms of the Preamble of our Constitution as reproduced below:
“We the People of Ghana, IN EXERCISE of our natural and inalienable right to establish a framework of government, which shall secure for ourselves, and posterity the blessings of liberty, equality of opportunity and prosperity;
IN A SPIRIT of friendship and peace with all peoples of the world;
AND IN SOLEMN declaration and affirmation of our commitment to;
Freedom, Justice, Probity and Accountability;
The Principle that all powers of Government spring from the Sovereign Will of the People;
The Principle of Universal Adult Suffrage;
The Rule of Law;
The protection and preservation of Fundamental Human Rights and Freedoms, Unity and Stability for our Nation;
DO HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.”
This preamble should be posted on the walls of every public office including the Judicial council. It should replace the picture of the President in every office of our Republic, henceforth.
