Court of Appeal rejects NAM1’s bid to stop criminal trial

The Court of Appeal has dismissed an application by Nana Appiah Mensah, popularly known as NAM1, seeking to halt his ongoing criminal trial.

NAM1, the Chief Executive Officer of the now-defunct Menzgold Ghana Limited, filed the motion while challenging a High Court decision that ordered him to open his defence in a case involving several criminal charges.

These charges include selling gold without a license, defrauding by false pretence, fraudulent breach of trust, and money laundering.

His legal team appealed the High Court ruling and simultaneously filed for a stay of proceedings pending the appeal’s outcome.

On Monday, May 19, 2025, state prosecutors opposed the stay request, arguing that it sought to overstep judicial authority and failed to show any exceptional reason to justify halting the trial.

A three-member panel led by Justice Gbiel Suurbaareh, with Justices Afia Serwaa Asare-Botwe and Christopher Archer concurring, unanimously dismissed the application.

Frederick Forson, a spokesperson for Menzgold’s aggrieved customers, welcomed the ruling, calling it a positive step toward justice.

NAM1, however, has indicated plans to escalate the matter to the Supreme Court, pending legal counsel.
