A High Court in Accra has dismissed an injunction application filed by Nana Akua Afriyie, the NPP’s 2024 parliamentary candidate for Ablekuma North, aimed at halting the Electoral Commission’s (EC) planned rerun in 19 polling stations.
Presiding Judge Justice Ali Baba Abature ruled on July 9 that the motion lacked merit and emphasized that the balance of convenience favours the EC’s constitutional responsibility to ensure representation for the constituency.
Afriyie’s legal team argued that the EC’s decision to rerun polls contradicts a High Court judgment from January 4, 2025, which instructed the Commission to collate results from 62 polling stations and declare a winner from the December 7, 2024, election.
Lawyer Gary Nimako, representing the NPP, stated that subsequent EC communications, including a January 27 press release and a briefing to Parliament, indicated only three polling stations were left uncollated, making the planned rerun unjustified.
He further cited Regulation 42 of the Public Elections Regulations, 2020 (C.I. 127), which allows reruns only in the event of a tie, arguing that all “pink sheets” had already been certified and did not require further verification.
Justice Abature, however, ruled that the applicant failed to prove the EC could legally finalize results without additional verification.
He upheld the EC’s constitutional mandate, noting that delaying the rerun would disenfranchise voters.
“After carefully reviewing the motion, affidavits, and statements filed, the application for injunction is dismissed as unmeritorious,” the judge stated.
He concluded that any losses incurred by Afriyie could be addressed through compensation if her main legal challenge succeeds.
