The Human Rights Division of the High Court has struck out suspended Chief Justice Gertrude Araba Essaba Torkornoo’s application for judicial review, describing it as an “abuse of court processes” and stating that the court lacked jurisdiction to hear the matter.
Presiding judge, His Lordship Kwame Amoako, ruled that he was not empowered to adjudicate parts of the application that related to ongoing removal proceedings against the Chief Justice.
Justice Torkornoo had approached the court to halt the Committee hearings, citing procedural irregularities and the failure to provide her with authenticated copies of the petitions and corresponding responses filed against her.
She also raised concerns over what she described as inhumane treatment, including a body search, when she appeared before the Committee.
In her suit, the suspended Chief Justice argued that the Committee was improperly constituted, had violated her right to a fair hearing, and had already conducted void proceedings.
However, the High Court dismissed her claims, stating that the issues raised fell outside its authority and could not be addressed in that jurisdiction.
