CJ will be reinstated if cleared of wrongdoing – Presidency assures

The Presidency has reassured Chief Justice Gertrude Torkornoo that if she is found not guilty of the charges against her, she will be returned to her prestigious position.

This assurance was forthcoming from Deputy Presidential Spokesperson Shamima Muslim during an appearance on Original FM/TV’s Adwenekasa programme.

Shamima clarified that the President’s decision to suspend the Chief Justice, pending an impartial investigation into multiple petitions against her, is a constitutional imperative, strictly in accordance with Article 146(6) of the 1992 Constitution.

“This is not a conviction. It’s a constitutional procedure to investigate serious allegations. If she is found not guilty, she will be reinstated,” Shamima emphasized

The Presidency’s stance comes in response to criticisms alleging that President John Dramani Mahama had contravened the Constitution. However, Shamima firmly rejected these claims, asserting that adherence to the Constitution cannot be construed as a breach of it.

“Following the Constitution cannot be interpreted as a breach of it,” she maintained.

The suspension of the Chief Justice and the subsequent investigation have sparked intense debate, with the Presidency seeking to allay concerns and reassure the public that due process is being meticulously followed.

A five-member committee has been constituted to scrutinize the allegations in detail, and the President’s actions have been taken in consultation with the Council of State, in conformity with constitutional provisions.
