The Kumasi High Court has held that both Akosua Serwaa and Odo Broni are wives of the late music legend, Daddy Lumba.
According to the court, Akosua Serwaa failed to prove that Daddy Lumba married her under civil law.
Amos Blessing Amorse reacting to the news said “In fact, if she had successfully proved that she was married under civil law, Odo Broni’s purported marriage would have been void.”
“The Court held that Akosua Serwaa was married under customary law. Marriage under customary law is potentially polygamous, unlike marriage under civil law.
What this means is that, when you contract a marriage under customary law, you can, generally, contract another marriage without breaching any law.
However, when you contract a marriage under civil law, you cannot marry another woman. In the case of Daddy Lumba, the court concluded that both marriages were contracted under customary law.
The reverse is that, if Daddy Lumba had married Odo Broni under civil law, the marriage would have nullified Akosua Serwaa’s customary law marriage.” – He writes
